Shopper Pursues Negligence Claim After Falling Merchandise Incident at Orange Park Ross Store

TAMPA, Fla., October 23, 2026 – Black Rock Trial Lawyers and counsel Gil Sanchez, Esq., represent a shopper pursuing a negligence claim arising from an October 25, 2024, incident at the Ross store at 510 Blanding Boulevard in Orange Park, Clay County, Florida.

According to the proposed complaint, the client was walking through a customer aisle near bedding merchandise when a king-size comforter set fell from an elevated shelf, striking the top of her head and her back. The client reports an immediate shock-like sensation traveling from her neck down her spine toward her feet, along with pain and difficulty standing. She reported the incident to store personnel.

The proposed complaint alleges that the impact caused bodily injury and aggravated preexisting spinal and related symptoms. It describes continuing pain, ongoing treatment and functional limitations, including impairment of the client’s ability to walk and perform ordinary activities. The claimed losses also include mental anguish, inconvenience, loss of enjoyment of life and medical expenses.

The negligence claim focuses on the arrangement and maintenance of the elevated bedding display. The proposed complaint alleges that Ross negligently maintained the display, allowing a bulky comforter set to fall into a customer aisle. It also alleges failures to reasonably inspect and correct the unsafe condition and to provide an adequate warning. It further alleges that Ross knew, or should have known through reasonable inspection and maintenance, of the condition and should have corrected it before the incident.

The proposed complaint is directed to the Circuit Court of the Fourth Judicial Circuit in and for Clay County, Florida, and requests a jury trial. It seeks damages exceeding $50,000 and requests compensation for past and future economic and noneconomic losses to the extent established by the evidence, with the amount to be determined by a jury.

The allegations remain unproven, and liability and damages have not been determined.
