Florida Lawsuit Alleges Unsafe Top-Shelf Display at Walmart Led to Customer’s Head Injury

PALM BEACH COUNTY, Fla. – A lawsuit filed in the Circuit Court for Palm Beach County alleges that Walmart Stores East, LP failed to safely merchandise heavy products, resulting in a customer suffering serious head injuries after a heavy package of canned energy drinks allegedly fell during an attempt to remove it from a top shelf.

According to the complaint, Plaintiff Xander Ash was shopping at a Walmart store in Lake Worth Beach on June 28, 2024, when he attempted to retrieve what appeared to be a smaller package of energy drinks from a top shelf. The lawsuit alleges that the product was actually a much heavier twelve-pack, which slipped and struck him in the head. The complaint further alleges that the product’s true size and weight were not readily apparent before it was removed from the shelf.

The lawsuit contends that Walmart knew or should have known that placing heavy beverage multipacks on upper shelves in a self-service retail environment creates a foreseeable risk of injury to customers. It alleges the company failed to use safer merchandising practices, failed to provide adequate warnings, failed to require employee assistance for retrieving heavy products, and failed to properly train employees responsible for stocking merchandise.
“Our clients expect retailers to put customer safety first,” said attorney Gil Sanchez. “When stores choose to place heavy merchandise where customers are expected to retrieve it without assistance, they have a responsibility to do so safely. This lawsuit seeks accountability and encourages retailers to adopt practices that better protect the public.”

The complaint seeks damages for injuries allegedly sustained in the incident, including pain and suffering, medical expenses, lost earnings, and other damages permitted under Florida law. The allegations remain unproven, and Walmart will have the opportunity to respond in court.
