FORT MYERS WOMAN BRINGS PREMISES-LIABILITY LAWSUIT OVER CONCEALED PARKING-LOT HAZARD
TAMPA, Fla. – August 19, 2026 – Lesa Dyer has brought negligence and premises-liability claims against Wal-Mart Stores East, LP, South Pointe at Ft. Myers, LLC (Georgia), and Selig Enterprises, Inc. arising from an August 19, 2024 fall in the parking lot of Walmart Neighborhood Market #5321 at 9131 College Parkway in Fort Myers.
According to the complaint, Dyer was lawfully on the premises and was looking for her car when she encountered a low-profile wheel stop in or immediately adjacent to a designated accessible parking space. The lawsuit alleges that the wheel stop was unnecessary or redundant because a brightly colored concrete sign column at the head of the same space already limited a vehicle’s forward movement.
The complaint further alleges that the wheel stop was worn, faded or inadequately painted, lacked meaningful contrast with the pavement, and was harder to detect because of inadequate illumination, poorly maintained landscaping, shadows and visual clutter. It alleges that no effective warning, barrier or contrasting treatment alerted Dyer before she tripped and fell.
The lawsuit alleges that the permanent or recurring condition could have been identified through reasonable inspections and that the risk could have been reduced by removing or repositioning the wheel stop, restoring contrast, improving lighting, trimming landscaping, changing pedestrian routing or providing a warning.
Dyer alleges bodily injuries requiring medical evaluation and treatment, along with pain and suffering, disability, medical expenses, lost earnings and other damages. She seeks compensatory damages exceeding $50,000, other relief allowed by law and a jury trial.
