BLACK ROCK TRIAL LAWYERS FILES LAWSUIT AGAINST SPIRIT AIRLINES OVER ALLEGED DEFECTIVE AIRCRAFT SEAT THAT CAUSED PASSENGER INJURIES

MIAMI, FL — Black Rock Trial Lawyers has filed a lawsuit on behalf of Maria Posada against Calle Ocho Special LLC and Conch Hill Market Too LLC, alleging that dangerous and concealed conditions at a Little Havana commercial property caused Ms. Posada to suffer serious injuries after a fall in February 2026.

According to the complaint filed in the Circuit Court for Miami-Dade County, Ms. Posada was lawfully visiting the property located near SW 8th Street and SW 9th Avenue when she allegedly encountered a hidden and dangerous drop-off adjacent to a parking lot pedestrian access point.

The lawsuit alleges that the property owners created or allowed what appeared to be a pedestrian pathway through a hedge opening connecting the parking lot to the sidewalk. However, beyond the apparent walkway, the ground allegedly dropped approximately one to two feet without warning, causing Ms. Posada to lose her balance and fall.

The complaint further alleges that the dangerous condition was concealed by landscaping, curb design, and the visual appearance of the parking lot and sidewalk surfaces, making the area appear flush and safely traversable to pedestrians. The lawsuit claims the defendants failed to adequately inspect, repair, warn, barricade, illuminate, or otherwise make the area safe despite knowing—or having reason to know—that customers and visitors would use the opening as a pedestrian route.

“As alleged in the complaint, this was not an isolated or unavoidable hazard,” said counsel for the plaintiff. “The property owners allegedly maintained a condition that created the illusion of a safe pedestrian walkway while concealing a significant drop-off that posed a foreseeable danger to customers and visitors.”

Ms. Posada alleges she suffered bodily injury, pain and suffering, disability, mental anguish, medical expenses, lost earnings, and other damages as a result of the incident.

The lawsuit seeks damages in excess of $50,000 and demands a jury trial on all issues so triable.
