BLACK ROCK TRIAL LAWYERS FILES LAWSUIT AGAINST SPIRIT AIRLINES OVER ALLEGED DEFECTIVE AIRCRAFT SEAT THAT CAUSED PASSENGER INJURIES
FORT LAUDERDALE, Fla. — Black Rock Trial Lawyers has filed a negligence lawsuit in Broward County Circuit Court against Spirit Airlines, LLC on behalf of Plaintiff Brandon Rodriguez, who alleges he suffered serious injuries after being forced to sit in a defective aircraft seat during a May 2024 flight departing Fort Lauderdale-Hollywood International Airport.
According to the complaint, Rodriguez boarded a Spirit Airlines flight bound for LaGuardia Airport in New York on May 7, 2024. After taking his seat, he allegedly discovered that the seat cushion was dislodged from the frame and could not be secured properly. The lawsuit further alleges that Rodriguez repeatedly notified flight attendants about the dangerous condition and requested to be moved to another available seat because the flight was not full.
Despite those requests, the complaint alleges that Spirit Airlines personnel refused to relocate him, forcing Rodriguez to brace himself throughout the flight to avoid sliding in and out of the unstable seat. The lawsuit claims that as a direct result of the defective condition and the airline’s negligence, Rodriguez suffered serious and permanent bodily injuries.
“The safety of passengers should never be compromised by preventable maintenance failures or ignored safety complaints,” said Steven Capriati, Esq. of Black Rock Trial Lawyers, counsel for the Plaintiff. “This lawsuit seeks accountability for what we allege was a dangerous condition aboard the aircraft and a failure to take reasonable steps to protect a passenger after the problem was reported.”
The complaint alleges Spirit Airlines failed to properly inspect, maintain, repair, and operate the aircraft in a reasonably safe condition, and failed to correct a hazardous condition that the airline knew or should have known existed.
Rodriguez seeks damages in excess of $50,000 for alleged permanent bodily injury, pain and suffering, disability, medical expenses, lost earnings, and other damages under Florida law.
The case was filed in the Circuit Court of the Seventeenth Judicial Circuit in and for Broward County, Florida.
