Wrongful Death Lawsuit Filed Against Brickell Condominium Over Alleged Emergency Access Failures

Miami, Florida — April 2, 2026 — Black Rock Trial Lawyers, PLLC has filed a wrongful death lawsuit on behalf of the Estate of Edward Charles Grabarek against RBG Brickell Corporation, alleging that critical safety failures at a Brickell residential building led to a fatal delay in emergency medical care.

The lawsuit, filed in the Circuit Court of the Ninth Judicial Circuit in Miami-Dade County, arises from the tragic death of Edward Charles Grabarek on April 5, 2024. According to the complaint, Mr. Grabarek suffered a heart attack inside his residence at 1550 Brickell Avenue while his wife was present and emergency services were immediately called.

However, the complaint alleges that first responders were significantly delayed because the building failed to provide a required Fire Rescue Emergency Key needed to override elevator access controls. This delay, the lawsuit claims, prevented timely medical intervention and directly contributed to Mr. Grabarek’s death.

“Emergency responders should never be delayed by preventable building access issues,” said counsel for the Plaintiff. “This case highlights a serious breakdown in basic safety protocols that are designed to save lives.”

The lawsuit further alleges that RBG Brickell Corporation violated Florida Building Code requirements and Miami-Dade County safety regulations by failing to maintain proper emergency access systems, including readily available emergency keys for first responders.

The Estate, represented by Mr. Grabarek’s spouse, Pauline Grabarek, seeks damages for wrongful death, including loss of companionship, emotional suffering, and economic losses.

“This was a preventable tragedy,” the complaint states, asserting that had emergency personnel been able to access the building without delay, Mr. Grabarek may have survived.
