Tampa Law Firm Files Lawsuit Against Towing Company Over Unsafe Tow Truck Conditions That Caused Serious Injury

Tampa, FL — April 16, 2026 — Black Rock Trial Lawyers, PLLC has filed a lawsuit on behalf of Hernando County resident John DeMarco against Forever Towing LLC, alleging that dangerous and defective conditions in a tow truck led to a preventable fall and serious injuries.

According to the complaint, Mr. DeMarco was riding as a passenger in a tow truck operated by Forever Towing in April 2024 when he was injured while exiting the vehicle. The lawsuit alleges that the tow truck was equipped with unsafe and defective features, including a slippery step, a malfunctioning passenger door, and the absence of any grab bar or stabilizing handhold for passengers.

The complaint further alleges that as Mr. DeMarco attempted to exit the elevated truck, the passenger door opened excessively due to faulty hinges, the step lacked proper traction, and there was no available support to maintain balance—causing him to fall and sustain significant injuries.

“Companies that transport customers have a responsibility to ensure their vehicles are safe for ordinary use, including something as basic as getting in and out of the vehicle,” said counsel for Mr. DeMarco. “This incident was entirely preventable.”

The lawsuit claims that Forever Towing failed to properly inspect, maintain, and equip the vehicle, and failed to warn passengers of known hazards. As a result of the incident, Mr. DeMarco is alleged to have suffered serious and permanent injuries, including pain and suffering, disability, and ongoing medical expenses.

The case seeks damages in excess of $50,000 and demands a jury trial.
