What’s a Statute of Limitation and How Does that Effect My Legal Case?

Welcome to Simply Legal! Simply put, the statute of limitations is the deadline to file a lawsuit. If you wait too long, you lose your right to sue. Here in Florida, the time limit depends on the type of case:
- Personal injury cases? You have 2 yearsto file.
- Breach of contract? It depends on whether the contract is written or oral:
- Written contracts have a 5-yearstatute of limitations.
- Oral contracts have a 4-year statute of limitations.
- Civil rights violations? You have 4 yearsto take action.
- Worker’s compensation injuries? You have 2 years from the date you knew or should have known about the injury.
- Workplace Discrimination claims? Under anti-discrimination laws, you only have 180 days from the date of discrimination to file a charge with the EEOC.
If you miss the deadline to file suit, your case gets dismissed—no matter how strong your claim is.
