FOR IMMEDIATE RELEASE

Edgar Martinez Hernandez Seeks Compensation After Dale Mabry Highway Bicycle Collision

Tampa, Fla. – September 25, 2026 – Black Rock Trial Lawyers, PLLC is seeking compensation on behalf of Edgar Martinez Hernandez for injuries arising from a September 27, 2024 collision involving his electric bicycle at Dale Mabry Highway and South Village Drive in Hillsborough County. The complaint asserts negligence claims against the driver, the Florida Department of Transportation (FDOT), and Hillsborough County.

According to the complaint, the collision occurred at approximately 11:08 p.m. as Martinez Hernandez entered a marked crosswalk to travel south across South Village Drive. The driver was traveling southbound on Dale Mabry Highway and turning right onto South Village Drive when the front-right portion of his vehicle struck the bicycle. The impact separated Martinez Hernandez from the bicycle and caused him to fall to the pavement. Emergency medical personnel transported him to St. Joseph Hospital.

The complaint alleges that the driver failed to maintain a proper lookout, failed to observe Martinez Hernandez in the crosswalk, and failed to yield the right-of-way before turning into his path.

The claims against FDOT and Hillsborough County concern the condition and maintenance of the existing crosswalk markings. The complaint alleges that white pavement markings where turning vehicles entered the crosswalk were worn, faded, and insufficiently visible at night. It further alleges that the governmental defendants knew or should have known of the deterioration and failed to adequately inspect, maintain, restore, or address the markings and associated warnings.

Martinez Hernandez alleges that the deteriorated markings and negligent driving combined to cause or contribute to the collision. He seeks compensation for bodily injuries, medical expenses, pain and suffering, lost earnings, diminished earning capacity, and other losses. The complaint alleges that some or all of his injuries and losses are permanent or continuing.

The complaint seeks relief in the Circuit Court of the Thirteenth Judicial Circuit in and for Hillsborough County, Florida, and requests a jury trial. Attorney Gil Sanchez of Black Rock Trial Lawyers, PLLC represents Martinez Hernandez. The allegations are subject to proof in court.
