Sylvester Canty Jr. Brings Premises-Liability Action After Serious Fall at Acasa Ocala
TALLAHASSEE, Fla. – September 1, 2026 – Sylvester Canty Jr., through counsel Black Rock Trial Lawyers, has brought a civil premises-liability action against AHPC Hub Tallahassee LLC and The Affordable Housing Preservation Corporation. The action arises from a September 1, 2024 incident at the Acasa Ocala apartment complex, located at 1303 Ocala Road in Tallahassee.
According to the complaint, Mr. Canty was a lawful visitor walking through a grassy common area near the pool when a loose dog entered the area and pursued him. The complaint alleges that the dog was known to be vicious and was permitted to roam the property without a leash or restraint.
As Mr. Canty moved quickly away from the dog, the complaint alleges, he encountered wet, sloped ground in an area affected by recurring water leakage. The same area allegedly contained an exposed hole or opening associated with a utility or water-meter box that had not been safely covered. Mr. Canty allegedly lost his footing on the saturated ground, tripped at the opening, and fell farther down the slope.
The complaint states that witnesses observed the dog pursuing Mr. Canty and saw him fall in the utility or meter-box area. Mr. Canty was unable to get up because of severe pain and remained on the ground until emergency medical personnel arrived. He suffered a broken left hip, underwent emergency surgery, and was hospitalized.
The two-count complaint alleges that both defendants owned, operated, controlled, or maintained the property and its common areas. It further alleges that the defendants knew or should have known about the recurring leakage and wet ground, should have discovered the exposed opening through reasonable inspection, and failed to repair, cover, secure, mark, barricade, or warn about the condition. The complaint also alleges a failure to address the roaming dog, including by contacting animal control.
Mr. Canty seeks damages for his injuries and losses, including medical expenses, physical pain, mental anguish, loss of enjoyment of life, and other economic and non-economic damages. He has demanded a jury trial.
